Terms & Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and FUBC Coffee, a volunteer-operated coffee ministry of First Ukrainian Baptist Church (“FUBC Coffee,” “we,” “us,” or “our”). By accessing our website, creating a gift card account, placing a pre-order, or otherwise using any of our services (collectively, the “Services”), you agree to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must discontinue use of our Services immediately. We reserve the right to modify these Terms at any time. Continued use of the Services after modifications are posted constitutes acceptance of the revised Terms.

FUBC Coffee is a non-commercial, volunteer-operated ministry that sells coffee and specialty beverages during Sunday church services. Our website provides digital tools to support these ministry activities, including:

• A digital gift card system for pre-loading drink credits
• A pre-order system for ordering beverages in advance of service
• A tipping feature allowing users to send voluntary tips to the ministry
• A loyalty points system that rewards repeat purchases
• A voluntary “Pay It Forward” pool allowing members to contribute credits for others
• A community wall for sharing public messages within the church community
• Apple Wallet integration for convenient gift card access
• Push notifications, email notifications, and Live Activity updates for order status
• Face ID / Touch ID biometric authentication for secure card access
• A public financial transparency page showing ministry income and expenditures
• A volunteer coordination system for scheduling and RSVPs

FUBC Coffee is not a licensed financial institution, payment processor, or commercial enterprise. All funds received are used exclusively for the purchase of supplies and equipment necessary to operate the ministry. No individual receives compensation from ministry revenues.

3.1 Issuance and Activation

Digital gift card accounts are created through our website. A gift card account stores a credit balance representing funds pre-loaded at our physical service counter. Gift card balances are denominated in United States Dollars (USD). Gift card accounts are not financial accounts and are not insured by the FDIC or any other governmental entity.

3.2 Loading Funds

Credit may only be added to a gift card account by paying cash to an authorized FUBC Coffee volunteer at our physical counter. We do not accept electronic payments, credit cards, debit cards, or online payment methods of any kind. The minimum and maximum load amounts are set at the discretion of ministry leadership and may change without notice.

3.3 Use of Gift Card Balance

Gift card balances may be redeemed for beverages at FUBC Coffee's Sunday service counter. Current pricing is: $1.00 (kids' size), $2.00 (12 oz), and $3.00 (16 oz). Prices are subject to change at any time without prior notice. Gift card balances may also be used to contribute to the Pay It Forward pool or to send voluntary tips ($1, $2, or $3) to the ministry.

3.4 No Cash Redemption

Gift card balances have no cash value and may not be redeemed for cash, transferred to another gift card, or exchanged for any form of monetary compensation. Gift card balances are non-refundable except as required by applicable law.

3.5 No Expiration

Gift card balances do not expire due to inactivity. However, accounts that have maintained a zero balance for twenty-four (24) consecutive months may be archived or deleted at our discretion, in accordance with our Privacy Policy.

3.6 Lost or Stolen Cards

You are responsible for safeguarding your gift card QR code and PIN. FUBC Coffee is not liable for unauthorized use of your gift card balance resulting from your failure to protect your credentials. If you believe your account has been compromised, contact us immediately at fubcband@gmail.com. We will make commercially reasonable efforts to assist, but we cannot guarantee recovery of lost or misused balances.

3.7 Account Security

You are solely responsible for maintaining the confidentiality of your PIN and QR code. You agree not to share your account credentials with any third party. Any transaction completed using your credentials will be deemed authorized by you.

3.8 Errors and Disputes

If you believe a transaction on your gift card account is erroneous, you must notify us within thirty (30) days of the transaction date by contacting fubcband@gmail.com. We will investigate and, if an error is confirmed, correct your balance within a reasonable time. We are not responsible for errors you fail to report within this window.

Pre-orders placed through our website are requests, not guaranteed commitments. While we make every effort to fulfill pre-orders, FUBC Coffee reserves the right to cancel or modify any pre-order due to supply limitations, volunteer availability, or operational constraints. In the event a pre-order cannot be fulfilled, any associated gift card charge will be reversed.

Pre-orders must be placed during the pre-order window, as determined by ministry leadership each Sunday. Pre-orders placed outside this window may not be fulfilled.

You are responsible for monitoring the status of your pre-order via your gift card page or at the service counter. FUBC Coffee is not responsible for unclaimed pre-orders.

The Pay It Forward Pool (“Pool”) is a voluntary community fund that allows users to contribute gift card credits for use by other members of the church community who wish to enjoy a beverage. Contributions to the Pool are entirely voluntary and irrevocable. Once contributed, funds cannot be reclaimed or reversed.

Claims from the Pool operate on an honor system and are limited to one claim per person per hour via our website. FUBC Coffee does not verify the identity or eligibility of Pool claimants and assumes no liability for misuse of Pool funds. We reserve the right to modify or discontinue the Pool at any time.

FUBC Coffee allows you to send voluntary tips ($1.00, $2.00, or $3.00) to the ministry from your gift card balance. Tips are entirely voluntary, irrevocable, and non-refundable. Tips are recorded as ministry income and are used exclusively to fund coffee ministry operations. Tipping requires PIN verification. You cannot tip more than your available gift card balance.

FUBC Coffee may award loyalty points based on your purchases and engagement with our services. Loyalty points have no cash value, are not transferable, and may not be redeemed for cash or credit. We reserve the right to modify, cap, or discontinue the loyalty points program at any time without notice. Points may be forfeited if we determine they were earned through fraudulent or abusive activity.

The community wall feature allows users to post public messages visible to all users of our services. By posting a message, you grant FUBC Coffee a non-exclusive, royalty-free license to display your message on our platform. You are solely responsible for the content of your messages and agree not to post content that is offensive, defamatory, harassing, or otherwise inappropriate. We reserve the right to remove any message at our sole discretion without notice.

Our iOS app allows you to add your gift card to Apple Wallet for convenient access. The Apple Wallet pass is generated on your device and contains your card identifier and QR code. Use of Apple Wallet is subject to Apple's own terms of service. FUBC Coffee is not responsible for the functionality of Apple Wallet or any issues arising from Apple's platform.

Our iOS app may send push notifications (via OneSignal), email notifications (via Resend), and display Live Activity updates on your Lock Screen and Dynamic Island. You can control which notifications you receive through the in-app notification settings. By opting in to notifications, you consent to receiving transactional messages related to your orders. We do not send promotional or marketing notifications.

Live Activities display real-time order status on your device and are processed entirely on-device. You may disable Live Activities at any time through your notification settings.

Our iOS app offers Face ID and Touch ID authentication as a convenient alternative to manual PIN entry. Biometric data is processed entirely on your device by Apple's LocalAuthentication framework and is never transmitted to or stored on our servers. You may enable or disable biometric authentication at any time. FUBC Coffee is not responsible for failures in biometric recognition.

The volunteer scheduling and RSVP features of our website are provided for organizational purposes only. Volunteer participation in FUBC Coffee ministry activities is entirely voluntary. Use of the RSVP system does not create an employment relationship, contractor relationship, or any legally binding commitment between any volunteer and FUBC Coffee or First Ukrainian Baptist Church.

RSVP links are distributed to volunteer group members and are not intended for public distribution. You agree not to share RSVP links with individuals outside the intended volunteer group.

You agree not to:

• Use our Services for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any portion of our Services or systems
• Use automated scripts, bots, scrapers, or other tools to access or interact with our Services
• Exploit the Pay It Forward system through repeated fraudulent claims
• Post offensive, defamatory, harassing, or inappropriate content on the community wall
• Impersonate another user, volunteer, or administrator
• Introduce malicious code, viruses, or disruptive elements into our systems
• Use our Services to transmit unsolicited commercial communications
• Attempt to reverse-engineer, decompile, or extract source code from our Services
• Circumvent any security measures, rate limits, or access controls implemented in our Services

We reserve the right to suspend or terminate access to our Services for any user who violates these Terms, without notice or liability.

All content, design, code, branding, and materials on our website are the property of FUBC Coffee and its contributors, and are protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any content from our website without express written permission.

15.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE OPERATION. WE DO NOT WARRANT THAT OUR SERVICES WILL BE AVAILABLE AT ANY PARTICULAR TIME OR THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED.

15.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUBC COFFEE, ITS VOLUNTEERS, ADMINISTRATORS, OR AFFILIATED CHURCH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF GIFT CARD BALANCE DUE TO UNAUTHORIZED ACCESS, OR SERVICE INTERRUPTIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES EXCEED THE GIFT CARD BALANCE HELD IN YOUR ACCOUNT AT THE TIME THE CLAIM ARISES, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

15.3 Indemnification

You agree to indemnify, defend, and hold harmless FUBC Coffee, First Ukrainian Baptist Church, and their respective volunteers and administrators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of another person or entity.

FUBC Coffee operates on a volunteer basis and its services are available primarily during Sunday church services. We make no representations or warranties regarding the continued availability of our website or digital services. We reserve the right to suspend, modify, or permanently discontinue any or all Services at any time without notice and without liability.

In the event that FUBC Coffee ceases operations permanently, we will make commercially reasonable efforts to notify gift card holders with remaining balances and arrange for balance settlement, but we cannot guarantee recovery of any outstanding balances.

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our Services shall first be submitted to good-faith negotiation. If not resolved within thirty (30) days, the dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Washington State, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Washington State to prevent irreparable harm pending arbitration.

You waive any right to participate in a class action lawsuit or class-wide arbitration against FUBC Coffee.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, shall be severed from these Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FUBC Coffee with respect to your use of our Services and supersede all prior agreements, representations, and understandings.
